美國結婚綠卡申請文件的問題

準備要申請i485，想請教幾個小問題：
1.剛完成結婚程序尚未收到certificate（需要6-8週才能收到），請問可以先寄送出485並註明證明文件後補嗎？是否會通知補件？
還是一定要拿到正式的結婚certificate才能遞出申請？

2.請問i130可以先送，等到收到結婚certificate之後再遞送i485？主要是因為七月中我的esta將到期，想問能否用先遞送130方式避免違法滯留？

1. 依照說明書來處理。說明書怎麼寫的就照辦。看完若不懂的話，你可以說一下你對說明書的哪一段的內容有疑惑。
2. 130和身份沒有任何關係。所以這樣做沒有任何意義。既然沒有好處，就不用討論能不能做了。

所以130跟妳的身分沒有關係

而且先送130不但沒好處還有壞處的，會造成處理的延遲

我不知道你在哪一州? 但是在德州這裡結完婚後, 法院會問你是否要申請一份7美元的臨時版的結婚證書, 還告訴我移民局接受臨時版的, 我也真的拿臨時版的去遞交 AOS, 都沒收到 RFE, 給你參考

回覆問題1，我是在485 checklist看到以下這段（粗體字部分），想確認一下結婚證書還未收到可否後補？或是可以等到收到後（但我的esta會逾期/配偶是公民）再一起遞件，避免補件拖延時間？

你的關鍵是130說明書

而且這段話是給印第安人、Amish、或特殊宗教這一類的人看的

你就老老實實的讓身分過期，不必想太多

喔...那我想問的是130要附的這個結婚證書影本（如下），是否可以用什麼方式註記後補？或是一定最好要等收到證書後再寄出i130？謝謝！
（另外想問fb類是什麼意思？...）

You have to prove that there is a family relationship between you and the beneficiary. If you are filing for a relative listed below, submit the following documentation to prove the family relationship.

依照規定，不可以事後補。
FB是親屬移民類別。你不是，你是IR類別

和政府辦事就是照規定來，就這麼簡單。沒明文說明可以事後補的就不可以。
