Our assessment of your application

We have completed a first assessment of your application and note that you may not be of good character and as a result, not eligible for a temporary entry class visa, unless granted a character waiver.

The provision in the New Zealand Immigration Instructions that appear to affect you is A5.45 (b).

A5.45 Applicants normally ineligible for a temporary entry class visa unless granted a character waiver

Applicants who will not normally be granted a temporary entry class visa, unless granted a character waiver include any person who:

a. has been convicted at any time of an offence against the immigration, citizenship or passport laws of any country; or

b.in the course of applying for a New Zealand visa, has made any statement or provided any information, evidence or submission that was false, misleading or forged, or withheld material information; or

c. at the time of application:
原文載於: 背包客棧自助旅行論壇 https://www.backpackers.com.tw/forum/showthread.php?t=1217406

i. has been charged with an offence, which on conviction, would make section 15 of the Immigration Act 2009 apply to that applicant; or
ii. is under investigation for such an offence; or
iii. is wanted for questioning about such an offence; or
d.has been convicted at any time of:

i. any offence for which they have been imprisoned; or
ii. an offence in New Zealand for which the court has the power to impose a term of imprisonment of at least three months; or
e. in support of any application by another person for a New Zealand visa (or a permit under the Immigration Act 1987), has made any statement or provided any information, evidence or submission that was false, misleading or forged.

This provision appears to apply to you because you have submitted an application on 28/05/2014 for a working holiday with Japan Working Holiday Scheme and again on 04/06/2014 with Finland working holiday scheme.

You later submitted an application on 5 June 2014 for a working holiday with Taiwan Working Holiday Scheme.

As you have applied for a working holiday visa with the Japan Working Holiday Scheme, you had made a declaration that the information submitted by you was true and correct.

However, as you are now applying under the Taiwan Working Holiday Scheme, it appears that you had provided information, evidence or a submission that was false or misleading.

There is a clear warning on the Working Holiday Website (http://www.immigration.govt.nz/migrant/stream/work/workingholiday/) which specifically advises that applying for a working holiday scheme that does not match your passport will result in the decline of your application and may be viewed as providing false and misleading information.

Note: You must apply for the working holiday scheme that matches the passport you intend to use to travel to New Zealand (for example, if you hold a Taiwan passport you must apply under the Taiwan Working Holiday Scheme). Applying for a working holiday scheme that does not match your passport will result in the decline of your application and may be viewed as providing false and misleading information. This may have an adverse impact on any future visa applications you submit.

Our assessment of your character

We have completed a final assessment of your character taking into account the information and comments you provided and have concluded that as you fall under the provisions of A5.45.

As such, you do not meet our good character requirements. This means that you are normally ineligible for a temporary entry class visa unless the character requirements are waived.

We have not made a decision on your application at this stage, and will be proceeding to consider your character as part of your visa application. We invite you to make comments or to provide further information to help us decide whether your circumstances justify waiving the temporary entry character requirements.

You may provide further information

Any comments or further information must be sent to this office within seven days of the date of this e-mail.

The relevant provisions of New Zealand immigration instruction A5.45 and A5.45.1 are attached. Please read this as it sets out the relevant character requirements including what matters will be taken into account when a character waiver is considered.

All supporting documents must be either original or certified copies of originals and, if not in English, must be translated into English by a recognised and independent translation service.

What happens if you do not send any comments or information?

If you do not send any comments or additional information by the date requested above we will make a decision on your application based on the information you have already given us. We are unlikely to approve your application based on this information.

E7.10 Considering an application:

d. If applicants do not respond within the specified time to a request from an immigration officer for further information, evidence or documents, or an interview, the application will be assessed on the relevant information available to INZ at the time.

Effective 02/12/2013

False or misleading information

e. in support of any application by another person for a New Zealand visa (or a permit under the Immigration Act 1987), has made any statement or provided any information, evidence or submission that was false, misleading or forged.

Note: When considering whether or not an applicant has committed an act that comes under A5.45 (b) or (e) above, immigration officers should establish whether, on the balance of probabilities, it is more likely than not that the applicant committed such an act.

A5.45 (d) does not apply to individuals undergoing an appeal process against their liability for deportation who have applied for a temporary entry class visa of the same class and type they currently hold.
A5.45.1 Action
a. An immigration officer must:

ii. if applicable consider, the significance of the false, misleading or forged information provided, or information withheld, and whether the applicant is able to supply a reasonable and credible explanation or other evidence indicating that in supplying or withholding such information they did not intend to deceive INZ;
iii. consider whether the applicant's reason for travel to New Zealand, and any surrounding circumstances, are compelling enough to justify making an exception to the character requirement, taking into account the public interest; and
iv. record reasons for deciding whether to waive or decline to waive the good character requirements; and
v. if they decide to decline the application, raise an 'Alert' against the applicant.
b.Any decision to determine the application in accordance with A5.45 must be made by an immigration officer with Schedule 1 - 3 delegations.

Effective 26/03/2012
E7.10 Considering an application

See also Immigration Act 2009 ss 26(4), 76(1)

a. Immigration officers must first determine applications for temporary entry in accordance with:

i. the requirements of the Immigration Act 2009; and
ii. the temporary entry instructions in force at the time the application is made or any general instructions given by the chief executive; and
iii. any relevant special directions.
b.If an application fails to meet the requirements of temporary entry instructions, officers must then consider all the circumstances of the application to see if an exception to temporary entry instructions is justified, taking into account the objectives of temporary entry instructions and the situation and purpose of the applicant. See also section E7.32 which refers to the grant of a limited visa or the imposition of bonds.

c. Officers must be satisfied that applicants for temporary entry are bona fide applicants (see E5.1 and E5.10).

d.If applicants do not respond within the specified time to a request from an immigration officer for further information, evidence or documents, or an interview, the application will be assessed on the relevant information available to INZ at the time.

As you have provided misleading information, you are ineligible for apply the visa, or you need to explain in full about the situation/mistake you have made
